Kathinokkula to Host Online F&I Panel at PALS 2016

LAS VEGAS — Software expert Kumar Kathinokkula will serve as moderator for a panel dedicated to online F&I at the upcoming P&A Leadership Summit, organizers announced Thursday. The event will be held Aug. 30–31, 2016, at Paris Las Vegas.

“Making F&I products available online for end consumers is a subject of great interest to dealers, agents and providers as car buying evolves ever closer to full online purchasing,” said Kathinokkula, who serves as COO of F&I Administration Solutions. “Doing so requires educating the consumers on the value propositions of these products, simplifying the choices, and ensuring the dealer stays in control of the transaction. I feel confident that, with the group we have convened for this panel, we can deliver an intelligent and thought-provoking discussion on this topic.”

The session, “Presenting F&I Products Online,” will also include Daniel Lievrouw, vice president of operations and IT at American Guardian Warranty Services Inc., and Brett Pomerantz, director of ecommerce for Cox Automotive and a founding member of the MakeMyDeal team.

“Any change to the F&I process, even in the name of progress, is bound to spur debate,” said David Gesualdo, show chair and publisher of P&A magazine. “My hat is off to Kumar, Dan and Brett for tackling the subject head-on, and I look forward to a memorable session.”

PALS Panel on Self-Governance Draws Interest

LAS VEGAS — Organizers of the annual P&A Leadership Summit have announced that “Govern or Be Governed,” a compliance-themed panel staffed by leading executives from the F&I product providers segment, is drawing marked interest among attendees. The event will be held Sept. 9–10 at Paris Las Vegas.

“It’s clear [the topic] has struck a nerve in the industry, where compliance in general and the machinations of the CFPB in particular weigh heavily on the minds of dealers and the directors of the companies that serve them,” said David Gesualdo, show chair and publisher of F&I and Showroom and P&A magazines. “The fact that many of the leading minds in the F&I products segment were willing to take on this topic is undoubtedly among the main reasons the panel is generating a high level of intrigue throughout the industry.”

The panel is scheduled to begin on Wednesday, Sept. 9, at 2 p.m. Moderator Tim Meenan, an attorney and managing partner of Meenan PA, will be joined by Steve Amos, president of GSFSGroup; David DeCredico, senior vice president of business development for EasyCare; Doug Frey, Allstate Dealer Services’ executive vice president and COO; Mark Macek, president of United States Warranty Corp.; and Kelly Price, president of National Automotive Experts.

Among other topics, the panel is expected to speculate on what form guidance from the Consumer Financial Protection Bureau in the F&I products arena might take, including price or markup controls; whether product providers can stave off new regulations by preemptively imposing their own rules; and how providers, agents and dealers can work together to ensure that their interests, as well as those of car buyers, can be protected in such a scenario.

Registration for the P&A Leadership Summit is now open. More information, including the full agenda, speakers and hotel room block is available at the event’s website. His presentation is expected to shed light on recent decisions and proposed regulations by the U.S. Tax Court and the Internal Revenue Service (IRS).

“In the magazines and at our conferences, we rely on experts to read between the headlines and deliver the information we need to get on with our work,” said David Gesualdo, show chair and publisher of F&I and Showroom and P&A magazines. “Mark Anderson has promised to do exactly that, and we look forward to welcoming him to the PALS stage.”

Their session, “The Power of Digital F&I: What it means for F&I Administrators,” will focus on the research and benefits of online F&I shopping processes and offer different perspectives on what needs to happen within the industry to move F&I product information upfront in the online shopping process — now and into the future.

“We are excited to offer our attendees the insight that this powerful duo has to offer administrators,” said David Gesualdo, show chair and publisher of F&I and Showroom and P&A magazines. “Their knowledge of digital F&I processes will make for a valuable takeaway to all who attend.”

“I look forward to attending the P&A Leadership Summit and discussing the acquisitions and merger of National Auto Care and Family First Dealer Services, which have proven to be a tremendous investment for Trivest Partners,” Gross said. “I will touch on valuation, the variables we looked for, the aspects we liked and perhaps a few items I wish I had known before we completed the transactions. I will also speak to the process and effort of combining the two businesses.”

Gross joined Trivest Partners in 2006, after a successful tenure at Credit Suisse Boston. He has since been involved in over 20 transactions with an aggregate value of more than $600 million. Gross currently serves on the board of directors for NAC as well as GetixHealth and Northfield Industries.

NADA’s Koblenz Joins Industry Summit Roster

LAS VEGAS — Organizers of the annual P&A Leadership Summit have announced that Andy Koblenz, executive vice president of legal and regulatory affairs for the National Automobile Dealers Association (NADA), will deliver a keynote address at Industry Summit 2015, which will be held Sept. 8–10 at Paris Las Vegas. Attendees who register for the P&A Leadership Summit are invited to attend.

“Andy Koblenz is a familiar face at Industry Summit and a great friend to dealers everywhere,” said David Gesualdo, show chair and publisher of F&I and Showroom and P&A magazines. “His experience speaks for itself, and we anticipate a gripping and informative address.”

Since 2006, Koblenz has spearheaded critical efforts to protect franchised new-car dealers from federal regulatory overreach. He represents dealers before all federal regulatory agencies and is at the forefront of NADA’s advocacy efforts to protect consumer choice in indirect auto financing. Along with the nation’s top dealer groups, he helped launch NADA’s optional Fair Credit Compliance Policy and Program, which helps dealers and lenders comply with fair credit rules while preserving robust competition for car buyers in the auto finance marketplace.

“The upcoming Industry Summit will provide an ideal forum to discuss a resolution of the challenges to the indirect vehicle financing model presented by the Consumer Financial Protection Bureau,” Koblenz said. “As a matter of principle, car buyers have the right to negotiate the rate on auto loans. And they have the right to seek a better deal. No government institution should deny that. That’s not what Washington is supposed to do.”

Koblenz directs a staff of six attorneys specializing in franchise and state law, corporate law and federal regulatory affairs. He helped navigate NADA through intensely challenging times, including the credit crisis, automaker bankruptcies and Great Recession. Previously, he served as NADA’s vice president of industry affairs.

“I’m honored to deliver keynote remarks at the Industry Summit, which brings together new-car dealers and their managers and others in the auto financing community to hear from industry experts on a variety of financing and retailing topics,” Fox said. “Our industry is constantly overcoming challenges while seeing new ones arise. Forums like this allow us to continue an open dialogue with our industry partners to discuss NADA’s top issues, which include protecting consumer access to credit, promoting the value of the dealer franchise network and refocusing our efforts as a trade association to better serve our dealer members.”

Las Vegas – Attorney Tim Meenan will deliver a keynote address at the P&A Leadership Summit on Tuesday, September 9, 2014. Meenan will explain the often misunderstood and ever-changing state and federal regulatory laws, discuss their impact on service contract providers and look at strategies for compliance.

Meenan is the managing shareholder at Tallahassee, Florida-based law firm, Meenan Regulatory and Legislative Attorneys. The firm serves as the general counsel to both the Service Contract Industry Council and the Florida Service Agreement Association. They have drafted and implemented the significant changes to statutes and rules governing automobile, home and consumer goods service contracts throughout the United States for the last 20 years.

As former deputy treasurer for the State of Florida, Meenan oversaw Florida’s four billion-dollar state treasury as well as three other divisions of the Florida Department of Insurance, including the division of risk management. He also served for three years as the executive assistant to the Florida insurance commissioner, where he helped formulate and implement legislative and regulatory proposals for the department.

“Attendees can look forward to having a much better understanding of today’s regulatory environment after hearing Tim speak,” says David Gesualdo, show chair and publisher of P&A, F&I and Showroom and Auto Dealer Monthly, “He has a broad understanding of regulatory law and possesses the unique ability to break down the information in a way that is easy to understand and apply to one’s own business.”

The P&A Leadership Summit is a joint production between P&A and F&I and Showroom magazines. It is scheduled for Sept. 8-9 at the Paris Las Vegas Hotel. For more info, visit pa-leadershipsummit.com or contact Eric Gesualdo via email hidden; JavaScript is required or at (727) 947-5823.

P&A Leadership Summit to Examine US Fidelis Debacle

LAS VEGAS — The rise and fall of US Fidelis will take center stage at the first annual P&A Leadership Summit, as attendees will hear from the firm that presided over the wind down of the direct-to-consumer marketer of vehicle service contracts.

The discussion, “US Fidelis: Lessons Learned from the Inside,” will feature Amherst Partners’ Scott Eisenberg, who served as the chief restructuring officer of US Fidelis. He will be joined by colleague Terry Keating, managing director of the investment banking, corporate restructuring and management advisory firm.

“Three years ago, we had hoped to bring out Scott and Terry to speak about US Fidelis,” said Gregory Arroyo, editorial director of F&I and Showroom and Auto Dealer Monthly magazines. “Unfortunately, settlements related to the company’s bankruptcy were still being negotiated, and they were unable to deliver their address. At that time, Scott and Terry promised they’d make it up to us when they were free to speak on the now-defunct marketer of vehicle service contracts. Well, that time has come, and they have agreed to deliver the untold story of US Fidelis. This is a can’t-miss session.”

Eisenberg, founder and managing partner of Amherst Partners, is a turnaround expert with more than 20 years of experience providing investment banking and restructuring services to a wide variety of companies. He was part of the independent team assigned to manage US Fidelis after it filed for bankruptcy on March 1, 2010. Under Eisenberg, the former Wentzville, Mo.-based company filed suit against its former owners, Darain and Cory Atkinson, for operating a doomed-to-fail enterprise that ignored at least $100 million in liabilities.

Darain and Cory were sentenced by a Missouri court late last year to prison terms of eight and four years, respectively, for stealing consumers’ refunds, insurance fraud and consumer fraud. They originally came under investigation in 2008 by the Pennsylvania attorney general’s office for violating federal Do-Not-Call rules, among other violations. The firm also faced a slew of lawsuits filed by competitors, automakers, including BMW of North America, other state regulators and consumers.

Keating, who has spent more than 20 years serving financial services and related companies in a variety of capacities, including multiple assignments involving service contract servicers, providers and financiers, and Eisenberg will use the US Fidelis story to advise product providers and administrators on the considerations they need to make before expanding into new markets through partnerships and acquisitions.

“US Fidelis was a dark chapter in our industry, and we didn’t invite Scott and Terry to dredge up bad memories,” said David Gesualdo, show chair and publisher of F&I and Showroom and Auto Dealer Monthly. “Our goal is to confront that company’s bad practices and learn how we, as an industry, can make sure they remain in the past.”

The P&A Leadership Summit is a joint production between P&A and F&I and Showroom magazines. The event will be held on the afternoon of Monday, Sept. 16, at Paris Las Vegas, concluding shortly before the evening keynote and welcome reception for the annual Industry Summit. Industry Summit attendees can add the P&A Leadership Summit to their registration for an additional fee of $395.
